Migrants deported to dangerous third countries deserve return to the United States when risk claims prove credible

The First Circuit’s September 18, 2026 decision in DVD v DHS invalidated the Trump administration policy permitting deportations to third countries not named in removal orders. DHS must follow destination priorities and give covered immigrants notice and a chance to raise persecution or torture concerns.
